Affiliate Programme

1. About the Affiliate Programme
The MWCanHelp Affiliate Programme enables individuals, professionals, organisations and other suitable partners to refer aspiring and early-stage business owners to MWCanHelp.
MWCanHelp is a UK-based online consultancy providing practical, tailored support to people who are starting or developing a business.
Our services include:
Strategic Business Planning
Business Formation Advisory
Funding Readiness Advisory
Marketing Strategy Consulting
Sales Strategy Consulting
Executive Coaching
MWCanHelp provides tailored one-to-one consultation and coaching designed around the individual needs, circumstances and goals of each client.
Approved affiliates can receive 25% commission on the first qualifying transaction generated through their approved referral.
2. Eligibility
The MWCanHelp Affiliate Programme is open to individuals, professionals, organisations and other suitable partners who can appropriately introduce potential clients to MWCanHelp.
Affiliates must:
Provide accurate information about MWCanHelp and its services
Represent MWCanHelp professionally and honestly
Only make claims about MWCanHelp that are supported by information provided by MWCanHelp
Clearly disclose their affiliate relationship where required
Comply with applicable laws and regulations when promoting MWCanHelp
Follow this Affiliate Programme Policy
MWCanHelp reserves the right to decline an application or refuse participation in the programme.
3. Commission structure
Approved affiliates will receive 25% commission on the first qualifying transaction made by a new client successfully referred to MWCanHelp.
First transaction only
Commission is one-time only.
Affiliates will not receive commission on:
Subsequent purchases
Additional services
Renewals
Repeat transactions
Subscriptions
Future payments
Additional sessions or packages purchased by the same client
There are no residual or recurring commission payments under the MWCanHelp Affiliate Programme.
Example
If an affiliate refers a new client who purchases a qualifying MWCanHelp service for £1,000, the affiliate will receive £250 commission, subject to the terms of this policy.
If that same client later purchases another MWCanHelp service for £1,500, no additional affiliate commission will be payable.
4. Qualifying transactions
A qualifying transaction is the first eligible paid purchase made by a new client where the purchase can reasonably be attributed to the affiliate’s approved referral.
Commission is calculated based on the actual amount paid by the client for the qualifying service.
Commission will not be calculated on amounts that have been:
Refunded
Cancelled
Reversed
Charged back
Successfully disputed
Provided free of charge
Free events, free resources and free community access do not qualify for affiliate commission.
MWCanHelp may determine whether a particular transaction qualifies for commission based on its records, referral information and the terms of this policy.
5. Referral attribution
A referral must be capable of being reasonably attributed to the affiliate.
MWCanHelp may use an affiliate link, referral code, referral form or another approved method to identify referrals.
Where more than one affiliate claims the same client, MWCanHelp will determine which affiliate is entitled to commission based on the available referral records.
MWCanHelp’s decision regarding referral attribution will be based on the information reasonably available to the business.
6. Existing clients and self-referrals
Commission will not normally be payable where the referred person:
Is already an existing MWCanHelp client
Has already purchased a MWCanHelp service
Has an existing active enquiry with MWCanHelp before the referral
Has already been introduced to MWCanHelp through another qualifying referral
Affiliates may not refer themselves, their own business or an organisation they control for the purpose of generating affiliate commission.
7. Commission payment
Commission will normally be paid within one calendar month after MWCanHelp has received the relevant qualifying customer payment.
This payment period allows MWCanHelp to validate the transaction and confirm that the payment remains valid.
Commission will only be payable where the underlying customer payment has not been:
Refunded
Cancelled
Reversed
Successfully disputed
Subject to a successful payment claim or chargeback
MWCanHelp may delay payment where additional time is reasonably required to verify the transaction.
8. Refunds, payment disputes and chargebacks
Where a client payment is subsequently refunded, reversed or successfully disputed, the associated affiliate commission will no longer be payable.
If commission has already been paid to an affiliate and the underlying customer payment is subsequently refunded, reversed or successfully disputed, MWCanHelp reserves the right to deduct the corresponding commission from future commission payments or otherwise recover the amount where appropriate.
Where a client uses a payment method that provides statutory or contractual payment dispute rights, the affiliate programme does not restrict or remove those rights.
A payment dispute or chargeback does not automatically determine whether a client remains contractually liable to MWCanHelp. Any outstanding contractual amount may be dealt with separately where appropriate.
9. Promoting MWCanHelp
Affiliates may promote MWCanHelp through appropriate channels, including:
Their own website
Social media
Email communications
Professional networks
Personal recommendations
Relevant online communities
Affiliates must promote MWCanHelp accurately, honestly and professionally.
Affiliates must not:
Make misleading or unsubstantiated claims
Guarantee business success
Guarantee a specific level of income
Guarantee funding
Guarantee customers or sales
Promise specific financial or commercial results
Misrepresent MWCanHelp’s services
Make commitments on behalf of MWCanHelp without authorisation
Use spam or deceptive marketing practices
Pretend to be MWCanHelp
Create websites or social media accounts that could reasonably be mistaken for official MWCanHelp channels
10. Advertising and marketing
Affiliates are responsible for ensuring that their promotional activities comply with applicable advertising, marketing, consumer protection and data protection requirements.
Where an affiliate may receive commission from a referral, the affiliate must clearly disclose the commercial nature of the relationship where required.
Affiliates must not make claims about MWCanHelp that cannot be reasonably supported.
MWCanHelp may request that an affiliate remove or amend promotional content that is inaccurate, misleading, inappropriate or inconsistent with the MWCanHelp brand.
11. Use of MWCanHelp branding
Affiliates may only use MWCanHelp’s name, logo, images, marketing materials and other intellectual property in accordance with materials or instructions provided or approved by MWCanHelp.
Affiliates must not:
Alter MWCanHelp’s branding in a misleading manner
Register domains incorporating the MWCanHelp name without permission
Create an unauthorised MWCanHelp social media account
Suggest that they are an employee or official representative of MWCanHelp
Use MWCanHelp branding in a way that could cause confusion about the relationship between the affiliate and MWCanHelp
12. Client relationships
The affiliate’s role is to introduce potential clients to MWCanHelp.
Once a referral has been made, MWCanHelp will communicate directly with the potential client regarding:
Services
Suitability
Pricing
Availability
Consultation arrangements
Payment
Service delivery
Affiliates must not make commitments on behalf of MWCanHelp regarding the services or the outcome a client may achieve.
The affiliate is not responsible for providing consultancy or coaching on behalf of MWCanHelp unless separately authorised in writing.
13. No guaranteed results
MWCanHelp does not guarantee that a client will achieve a particular business, financial, commercial or other outcome from using its services.
Affiliates must not make guarantees or promises about the results a potential client will achieve.
Affiliates must not represent that using MWCanHelp will guarantee profit, funding, customers, sales, business growth or any other specific result.
14. Personal data and privacy
Affiliates must handle personal information responsibly and in accordance with applicable data protection requirements.
Affiliates should not provide MWCanHelp with personal information about a potential client unless they have an appropriate lawful basis to do so and have provided any required information or obtained any required consent.
Where appropriate, affiliates should direct potential clients to contact MWCanHelp directly using the approved referral process.
MWCanHelp will process personal information in accordance with its Privacy Policy.
15. Independent affiliate relationship
Participation in the MWCanHelp Affiliate Programme does not create an employment relationship, partnership, joint venture or agency relationship between MWCanHelp and the affiliate.
Affiliates are independent third parties.
An affiliate must not represent themselves as an employee, director, partner or authorised agent of MWCanHelp unless expressly authorised to do so.
Affiliates are not authorised to enter into contracts, make agreements or provide commitments on behalf of MWCanHelp.
16. Tax responsibilities
Affiliates are responsible for managing their own tax affairs and any tax obligations arising from commission received through the MWCanHelp Affiliate Programme.
MWCanHelp does not provide individual tax advice to affiliates.
17. No guaranteed commission
Participation in the MWCanHelp Affiliate Programme does not guarantee that an affiliate will generate referrals, sales or commission.
The amount of commission earned will depend on the number of qualifying referrals and the value of the first qualifying transaction generated by those referrals.
18. Suspension and termination
Either MWCanHelp or an affiliate may end their participation in the Affiliate Programme.
MWCanHelp may suspend or terminate an affiliate’s participation where there is:
Suspected fraudulent activity
Misleading advertising
Abuse of the referral system
Unauthorised use of MWCanHelp branding
Spam or deceptive marketing
Unauthorised representation of MWCanHelp
A serious breach of this policy
Conduct that could reasonably damage the reputation of MWCanHelp
Conduct that could reasonably cause harm to a potential client or existing client
MWCanHelp may also suspend or terminate participation where an affiliate uses misleading, fraudulent or deceptive methods to generate a referral or transaction.
Where an affiliate relationship is terminated, qualifying commission that has already been earned and remains payable will be dealt with in accordance with this policy.
Commission connected to a transaction generated through fraudulent, deceptive or materially misleading activity will not be payable.
19. Changes to the Affiliate Programme
MWCanHelp may update this Affiliate Programme Policy from time to time.
Changes may include updates to:
Commission arrangements
Eligible services
Referral requirements
Payment procedures
Promotional requirements
Programme terms
Changes to the commission structure will apply to future qualifying referrals and will not ordinarily affect commission already earned before the effective date.
20. Complaints and disputes
If an affiliate has a complaint or dispute relating to the Affiliate Programme, they should first contact:

MWCanHelp will consider complaints fairly and will seek to resolve them through communication where reasonably possible.
Where appropriate, the parties may mutually agree to mediation or another suitable form of alternative dispute resolution before court proceedings are considered.
Alternative dispute resolution will not be compulsory unless required by law or separately agreed in writing.
Nothing in this section prevents either party from exercising any legal rights available to them.
21. Governing law and jurisdiction
This Affiliate Programme Policy is governed by the laws of England and Wales.
Subject to any mandatory rights available under applicable law, the courts of England and Wales will have jurisdiction over disputes arising from or relating to this Affiliate Programme Policy or participation in the MWCanHelp Affiliate Programme.
22. Severability
If any provision of this Affiliate Programme Policy is found to be invalid, unlawful or unenforceable, that provision will be interpreted or modified to the extent necessary to make it lawful where possible.
If it cannot be made lawful, it will be removed to the extent necessary, and the remaining provisions will continue in full force and effect.
23. Waiver
If MWCanHelp chooses not to enforce any part of this policy on a particular occasion, this does not mean that MWCanHelp has waived its right to enforce that provision in the future.
Any waiver must be agreed by MWCanHelp in writing.
24. Acceptance of the policy
By applying to or participating in the MWCanHelp Affiliate Programme, the affiliate confirms that they have read, understood and agree to comply with this Affiliate Programme Policy.
MWCanHelp reserves the right to refuse participation or terminate an affiliate relationship where the requirements of this policy are not met.
